By installing, accessing, or using any UpRevApps application or visiting our website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services.

3. Eligibility

To use our Services, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction.
• Have a valid Shopify store account.
• Have the authority to bind yourself or your business to these Terms.

4. Account and Installation

When you install one of our apps, you authorize us to access certain information from your Shopify store as necessary for the app to function. You are responsible for maintaining the security of your Shopify account and for all activities that occur under your account.

5. Acceptable Use

You agree not to:

• Use our Services for any unlawful purpose or in violation of any applicable laws.
• Reverse engineer, decompile, or disassemble any part of our applications.
• Attempt to gain unauthorized access to our systems or other users' data.

6. Intellectual Property

All content, code, designs, and materials associated with UpRevApps and our applications are owned by UpRevApps and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Services without our express written permission.

7. Pricing and Payments

Some of our apps may be offered free of charge, while others may require a subscription or one-time payment. Pricing details are provided on each app's listing page. All payments are processed through the Shopify billing system. You agree to pay all applicable fees as described at the time of installation.

8. Refunds

Refund policies, if applicable, are governed by the terms specified on each app's Shopify listing and the Shopify App Store policies.

9. Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that our Services will be uninterrupted, error-free, or completely secure. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law, UpRevApps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from or relating to your use of our Services, regardless of the theory of liability.

You agree to indemnify and hold harmless UpRevApps and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising from your use of our Services or violation of these Terms.

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. You may terminate your use of our Services at any time by uninstalling the app from your Shopify store.

13. Third-Party Services

Our apps operate within the Shopify platform. Your use of Shopify is subject to Shopify's own terms of service and policies. UpRevApps is not responsible for any actions, content, or policies of Shopify or any other third-party services.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms on this page with a new effective date. Your continued use of our Services after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania and applicable European Union regulations, without regard to conflict of law principles. Nothing in these Terms shall limit any rights you may have under mandatory consumer protection laws in your country of residence within the EU/EEA.

16. Dispute Resolution

Any disputes arising out of or in connection with these Terms shall be submitted to the competent courts of Vilnius, Lithuania, unless otherwise required by applicable EU consumer protection law. If you are an EU consumer, you may also be entitled to bring proceedings in the courts of your country of residence. You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
